- The couple must be living together at the time they apply for the marriage license.
- If you have already obtained Public Marriage License from County clerk and you just need a Civil Ceremony. then the presence of one witness is required since it is not a confidential marriage.
Legal requirements for getting married
- To marry in California, the two parties must be single.
- Be at least 18 years old.
- Both parties must appear in person.
- You don’t need to be a California resident to marry in California.
Divorce, widowed and annulment or legal separation applications
- Bring a certified copy of Divorce decree or death certificate or annulment if it taken place within the last 90 days.
- The date of divorce , the date of your spouse’s death or annulment must be provided.
- Starting on January 1, 2015, registered domestic partners in California must also file for dissolution,legal separation, or annulment to end their relationship.
Same Sex Marriage
- Same sex marriage are allowed and legally recognized in California.
Marriage Officiant
- The marriage officiant, e.g., clergy-person or authorized individual, who performs the marriage ceremony.
